Robocast News on Court Proceedings
Robocast filed patent infringement suits against Microsoft on December 6, 2010, and against Apple on March 21, 2011 in the United States District Court for the District of Delaware. Robocast's complaints identify various Microsoft and Apple products utilizing Robocast's automated browsing, including Microsoft's Bing, Windows Vista and msn.com, and Apple's Front Row, iTunes, and AppleTV.
In response to Robocast's complaints, Apple and Microsoft moved to transfer the cases to the Northern District of California, where Apple is headquartered. Apple also filed a motion seeking to dismiss portions of Robocast's complaint. Judge Andrews, who was assigned the case shortly after taking the bench in November 2011, held a hearing and quickly denied Microsoft's and Apple's motions to transfer, finding that venue is proper in the District of Delaware for both cases.
Moreover, Judge Andrews denied Apple's motion to dismiss on all bases except for a technicality, and allowed Robocast to amend its complaints, which it did on February 27, 2012. On March 7, 2012, Judge Andrews entered a case management order for both the Apple and Microsoft cases, setting trial for November 18, 2013.
